BOOKING CONDITIONS: All arrangements made between us, NERJA SPAIN FLATS, and you, THE GUEST, are subject to the following booking terms and conditions;
1. PROPERTY BOOKING Nerja Spain Flats are authorised by the owners, or their representatives, to offer their property(s) for rental. A contract will exist between Nerja Spain Flats and The Guest. Your rental property is considered booked upon receipt of the booking deposit or full payment. The deposit/full payment is required within 5 days of booking request to confirm the reservation. Your booking is only confirmed when Nerja Spain Flats receives the deposit or full payment, and you have received the confirmation email from Nerja Spain Flats. The Guest must notify us in writing with any requests to make changes to a confirmed booking. However, we cannot guarantee that we will be able to meet any such requests. Any accommodation booking is only for the use of the Guests named and numbered on the booking form, and any subletting, sharing or over occupation is prohibited. Pets are not allowed unless permission has been specifically given in writing.
Arrival and departure to/from the property is as per the dates stated on the booking form. Arrival check-in time is from 15:00 However we will always try to accommodate clients arriving early if we can. Departure time is 10:00. Failure to depart on time can result in the client being charged. If you require use of a property after 10:00 on the departure day please contact Nerja Spain Flats as we may be able to offer you the property or an alternative property for day use (charges vary depending on property size). On the day of your departure you should leave the apartment clean and tidy with all waste correctly disposed of. Please leave the keys where instructed and close the door behind you after making sure that you have all your personal belongings with you.
2. PAYMENTS All bookings are subject to a 20% deposit at the time of booking. ,The remaining balance for the reservation to be paid by your arrival date. A reminder will be sent before the due date. However, it is the responsibility of The Guest to ensure that the final payment is made by the due date. If the payment is not received on time, we would try to contact The Guest to request the payment. However, if the payment is still not received by due date, we shall be entitled to cancel the booking and retain the deposit without notice. This deposit/full/final payments should be paid by: Bank transfer in Euros or Pound Sterling to our Euro Spanish Bank Account or UK Pound Sterling Bank Account or by credit card as agreed in the Booking Confirmation Form. The Guest is responsible for all bank charges and must ensure the full amount reaches Nerja Spain Flats Bank Account.
3. CANCELLATION and/or CHANGES TO ORIGINAL BOOKING: up to 1 month prior to arrival, we permit free cancellation & agree to refund deposit paid if cancellation is made prior to 1 month before arrival date.
Cancellation within 1 month of arrival date, we cannot refund deposit. We agree to transfer booking & payment to a new date should we manage to rebook the apartment on the original reservation dates. All cancellations or changes must be made via email by The Guest listed on the Booking Confirmation Form.. It is a condition of booking that the Guest and their party has full insurance to cover against personal injury, damage, cancellation and medical insurance. All baggage, money and personal possessions remain at all times and in all circumstances at the Clients’ risk. Suitable insurance cover should be purchased to protect any items of value. Any cancellation, including force majeure, will be subject to the aforementioned cancellation policy.
4. CONDUCT IN PROPERTIES Loud music and parties are strictly prohibited. Guests in a Nerja Spain Flats Property should be aware that if loud music is played, or a party is held, and the neighbours complain and/or police are called, you may be immediately removed from the apartment regardless of the time, day or night. Noise regulations and respect for other residents between 22:00 and 10.00. We would appreciate your full cooperation in this matter and we hope you understand that these rules are necessary, as our properties are located in residential areas with people that have to get up early and go to work. The quiet time in the evening for the neighbours should therefore be respected. The Guest is responsible for taking care of the property and its contents. Before leaving, The Guest will leave the property in the condition it was in when they arrived; all equipment, furniture and utensils must be left clean and tidy which includes the crockery and cutlery, cleaned and stored in the appropriate cupboards, and ensure that the cooker, microwave and fridge are clean, all waste should be correctly disposed of and the apartment tidied. If the property is not left in a clean and tidy condition, there will be an additional cleaning charge which will be deducted from the damage deposit. On departure the Client will be responsible for making the accommodation secure with all doors and windows locked and the key left where instructed. The Client will pay for the cost of replacement or rectifying any damage from the damage deposit held by the Company. The Guest agrees to behave responsibly and correctly on behalf of their accompanying party as well as themselves. If this person, or any of the accompanying party behaves in an unsuitable and incorrect manner, Nerja Spain Flats reserves the right to ask the person and their accompanying party to leave the property. Furthermore, from that moment on they will have no right to future claims or any form of compensation. Finally, The Guest will lose all payments made including the apartment rental and the deposit.
5. SERVICES Nerja Spain Flats are unable to accept responsibility for any inconvenience caused by disturbance of any kind, and at any time from neighbouring property, land, tenants/clients or animals. Or by the failure of local services for any length of time, such as electricity, water supply, electric or gas equipment. Or for the unavailability of any general amenities, including television (analogue or satellite), swimming pools that may have to be drained and re-filled from time to time, road works or condition of roads. As we have no jurisdiction, we cannot guarantee availability in regard to community pools. It should be noted that most swimming pools are not available during the winter months, the usual available period for most complexes is May - October, but this is completely at the discretion of the complex President. The use of all electrical items such as- washing machine, dishwasher, iron, radio/cassette, kettle, coffee maker etc. is entirely at the discretion of the user, and the Company will not be responsible for any injury or damage that may be a result of such usage. The owners of each property provide the linen & towels, and Nerja Spain Flats will not be held responsible for the quantity or quality of such items. A guarantee cannot be given to the availability, or condition of BBQ’s. Views from the property may change from time to time due to happenings/building beyond our control, and cannot therefore always be guaranteed. 6. COMPLAINTS Any complaint regarding the accommodation must be reported to Nerja Spain Flats within 24 hours of your arrival. These complaints must be itemised, and presented in writing to Nerja Spain Flats. We will be unable to accept any subsequent claims unless this procedure is carried out in full compliance as stated above. Nerja Spain Flats will have no liability and will not investigate any complaint submitted after completion of the rental period.
6. FORCE MAJEUR Nerja Spain Flats and the Property Owners cannot accept liability or pay any compensation where the performance or prompt performance of their contractual obligations is prevented or affected by ‘force majeur’. In these terms and conditions of hire, ‘force majeur’ means any event which the Nerja Spain Flats, The Property Owner or the suppliers of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, government action or other events outside our control. On booking an property with Nerja Spain Flats you automatically accept our Terms and Conditions, which we expect you to comply with. Should The Guest fail to comply with any of the aforementioned Terms and Conditions, Nerja Spain Flats reserves the right to ask the client to leave the apartment, and the client in question can not request any form of compensation. NERJA SPAIN FLATS WEBSITE All the property descriptions and information apply to the published apartments. Whilst Nerja Spain Flats will do everything in its power to make sure that the details are correct and as accurate as possible, Nerja Spain Flats will assume no responsibility for any errors or omissions that may occur. Nerja Spain Flats reserves the right to change the published information on the website at any time including prices, descriptions, and photos. Nerja Spain Flats reserves the right to update any of these Terms and Conditions at any time if it is deemed necessary, and in the interest of Nerja Spain Flats. The Guest/s are responsible for reading the Terms and Conditions outlined on this page. Accepting the use of this website immediately implies that they have accepted any changes that may be made by any third party, and that the third party commits to complying with these changes. These Terms and Conditions do not affect the statutory rights of the user.
